Use of this website entails full acceptance of these Terms of Use. BG ABOGADOS & CONSULTORES provides on its websites information relating to the nature of its activities, products and services, subject to the following Terms of Use:

(c) Under no circumstances shall BG ABOGADOS & CONSULTORES be liable for any loss or damage of any kind arising from access to or use of the website, including, without limitation, damage to computer systems or damage caused by the introduction of viruses and/or cyber-attacks. (f) Access to this website does not confer on users any right or title in respect of the intellectual and/or industrial property rights in the contents hosted on this website. These provisions govern the use of the Internet portal service (hereinafter, the ‘Portal’) made available to Internet users by BG Abogados & Consultores (hereinafter, ‘BG Abogados & Consultores’).

(g) Access to the website is free of charge, save for the cost of the telecommunications connection supplied by the access provider contracted by users. Certain services are exclusively available to our clients and access to them is restricted. Legal or tax services generally provided by the Firm are charged at the price stated in the relevant commercial proposal and are under no circumstances offered or provided through the Portal service.

(h) Use of the Portal confers the status of Portal user (hereinafter, the ‘User’) and entails acceptance of all the terms contained in this Legal Notice. The Portal service is provided only for the period during which the User remains connected to the Portal or to any of the services made available through it. The User should therefore read this Legal Notice carefully each time the User intends to use the Portal, as both this Legal Notice and the Terms of Use contained herein may be amended.

(i) Certain Portal services, whether available to Internet users generally or exclusively to clients of BG Abogados & Consultores, may be subject to specific terms, regulations and instructions which, where applicable, replace, supplement and/or amend this Legal Notice and must be accepted by the User before the relevant service is provided.

2. Intellectual and industrial property

All contents of the Portal, including, by way of example only, texts, photographs, graphics, images, icons, technology, software, links and other audiovisual or audio content, as well as its graphic design and source code (hereinafter, the ‘Contents’), are the intellectual property of Carlos A. Bethencourt González, as owner of BG Abogados & Consultores, or of third parties. No exploitation rights recognised by applicable intellectual property legislation shall be deemed assigned to the User, except those strictly necessary for use of the Portal.

Trade marks, trade names and distinctive signs are owned by BG Abogados & Consultores or by third parties, and access to the Portal shall not be construed as conferring any right in respect of such trade marks, trade names and/or distinctive signs.

3. Conditions of use of the portal

3.1 General use

The User undertakes to make correct use of the Portal in accordance with the Law and this Legal Notice.

The User will be liable to BG Abogados & Consultores or third parties for any damages that may be caused as a result of failure to comply with said obligation.

Use of the Portal for purposes that are harmful to the property or interests of BG Abogados & Consultores or third parties, or that otherwise overload, damage or disable the networks, servers or other computer equipment (hardware), or computer products and applications (software), of BG Abogados & Consultores or third parties is expressly prohibited.

3.2 Contents

1. a) The User undertakes to use the Contents in accordance with the Law and this Legal Notice, as well as with the other conditions, regulations and instructions that may be applicable in accordance with the provisions of clause 1.
2. b) By way of example and without limitation, in accordance with applicable legislation the User shall refrain from:

• Reproducing, copying, distributing, making available, publicly communicating, transforming or modifying the Contents, except where authorised by law or expressly consented to by BG Abogados & Consultores or, as applicable, by the holder of the relevant exploitation rights.
• Reproducing or copying for private use any Contents that may be regarded as Software or a Database under applicable intellectual property legislation, or publicly communicating or making them available to third parties where such acts necessarily involve reproduction by the User or a third party.
• Extracting and/or reusing all or a substantial part of the Contents comprising the Portal or of any databases made available to Users by BG Abogados & Consultores.

3.3 Data collection forms

Without prejudice to clause 5 of this Legal Notice and to the privacy policies accessible through the Portal and applicable from time to time, use of certain services or requests addressed to BG Abogados & Consultores is conditional upon prior completion of the corresponding User registration. All information supplied by the User through the Portal forms for the above purposes or any other purpose must be truthful. To this end, the User warrants the authenticity of all data communicated and shall keep the information supplied to BG Abogados & Consultores fully up to date so that it reflects the User’s actual circumstances at all times. In any event, the User shall be solely responsible for any false or inaccurate statements made and for any loss or damage caused to BG Abogados & Consultores or third parties by the information supplied.

3.4 Linking to the Portal

Any Internet user wishing to insert links from their own webpages to the Portal must comply with the conditions set out below. Lack of knowledge of these conditions shall not exempt that person from liabilities arising under the law.

The link shall point only to the home page or main page of the Portal and may not reproduce it in any form (inline links, copying of texts, graphics, etc.).

In all cases, and in accordance with the applicable legislation in force from time to time, it is prohibited to establish frames of any kind that surround the Portal or enable the Contents to be viewed through Internet addresses other than those of the Portal and, in any event, where they are displayed together with content external to the Portal in such a way that:

(I) causes, or may cause, users to make an error, become confused or be misled as to the true origin of the service or Contents; (II) constitutes an act of unfair comparison or imitation; (III) is intended to take advantage of the reputation of the BG Abogados & Consultores brand or its standing; or (IV) is otherwise prohibited by applicable law.

1. f) The webpage from which the link is inserted shall not contain any false, inaccurate or incorrect statement concerning BG Abogados & Consultores, its partners, employees or clients, or the quality of the services it provides.
2. g) Under no circumstances shall the webpage containing the link state that BG Abogados & Consultores has consented to the insertion of the link or that it otherwise sponsors, collaborates with, verifies or supervises the services of the linking party.
3. h) The use of any word mark, figurative mark, combined mark or any other distinctive sign belonging to BG Abogados & Consultores on the linking party’s webpage is prohibited, except where permitted by law or expressly authorised by BG Abogados & Consultores and provided, in such cases, that a direct link to the Portal is enabled in the manner established in this clause.
4. i) The webpage establishing the link must comply fully with the law and may under no circumstances contain or link to its own content or third-party content that:

(I) is unlawful, harmful or contrary to morality or accepted standards of conduct (pornographic, violent, racist, etc.); (II) causes or may cause the User to form the false impression that BG Abogados & Consultores subscribes to, endorses, adheres to or in any way supports the lawful or unlawful ideas, statements or expressions of the linking party; (III) is inappropriate or irrelevant to the activity of BG Abogados & Consultores having regard to the location, content and subject matter of the linking party’s webpage.

4. Exclusion of liability

4.1 Information

Access to the Portal does not impose on BG Abogados & Consultores any obligation to verify the truthfulness, accuracy, adequacy, suitability, completeness or currency of the information supplied through it. The contents of this page are general in nature and do not, under any circumstances, constitute the provision of legal or tax advice of any kind. Accordingly, such information is insufficient for the User to make personal or business decisions.

BG Abogados & Consultores shall not be liable for decisions taken on the basis of information supplied on the Portal or for any loss or damage suffered by the User or third parties as a result of actions based solely on information obtained from the Portal.

4.2 Quality of service

Access to the Portal does not impose on BG Abogados & Consultores any obligation to monitor the absence of viruses, worms or any other harmful computer element. It is the User’s responsibility in all cases to have suitable tools available for detecting and disinfecting harmful computer programs. BG Abogados & Consultores shall not be liable for damage caused to the computer equipment of Users or third parties during provision of the Portal service.

4.3 Service availability

Access to the Portal requires third-party services and supplies, including transmission through telecommunications networks whose reliability, quality, continuity and operation are not the responsibility of BG Abogados & Consultores. Consequently, services provided through the Portal may be suspended, cancelled or become inaccessible either before or while the Portal service is being provided.

BG Abogados & Consultores shall not be liable for any loss or damage suffered by the User arising from failures or disconnections in telecommunications networks that cause suspension, cancellation or interruption of the Portal service during or prior to its provision.

4.4 Linked content and services

The Portal access service includes technical linking devices, directories and even search tools that allow the User to access other Internet pages and portals (hereinafter, ‘Linked Sites’). In such cases, BG Abogados & Consultores acts as an intermediary service provider in accordance with Article 17 of Spanish Law 34/2002 of 12 July on Information Society Services and Electronic Commerce (LSSI) and shall only be liable for content and services supplied on Linked Sites to the extent that it has actual knowledge of their unlawfulness and has failed to disable the link with due diligence.

If the User considers that a Linked Site contains unlawful or inappropriate content, the User may notify BG Abogados & Consultores in accordance with the procedure and effects set out in clause 6; such notification shall under no circumstances oblige BG Abogados & Consultores to remove the relevant link. The existence of Linked Sites shall under no circumstances imply the existence of agreements with their operators or owners, nor any recommendation, promotion or identification by BG Abogados & Consultores with the statements, content or services provided. BG Abogados & Consultores is not aware of the content and services of Linked Sites and therefore accepts no liability for damage arising from the unlawfulness, quality, obsolescence, unavailability, error or uselessness of the content and/or services of Linked Sites, or for any other damage not directly attributable to BG Abogados & Consultores.

5. Reporting illegal or inappropriate activities

If the User or any other Internet user becomes aware that Linked Sites refer to pages whose content or services are unlawful, harmful, degrading, violent or contrary to morality, that person may contact BG Abogados & Consultores and provide the following information:

Personal details of the reporting person: name, address, telephone number and email address; a description of the facts showing the unlawful or inappropriate nature of the Linked Site;

Where rights such as intellectual or industrial property rights have been infringed, the personal details of the holder of the infringed right where that person is different from the reporting person. Evidence establishing the rights holder’s standing must also be provided and, where applicable, evidence of authority to act on behalf of the rights holder where the latter is different from the reporting person. Receipt by BG Abogados & Consultores of the notification referred to in this clause shall not, for the purposes of the LSSI, constitute actual knowledge of the activities and/or content identified by the reporting person.
